Reason for Ban- Inciting unrest, promoting separatism, and posing a threat to India's unity and integrity.
Activities of JKIM and AAC- Promoting separatism in Jammu & Kashmir. - Anti-national and subversive activities. - Supporting terrorism, fostering hatred against the government, and inciting unrest.
Unlawful Activities (Prevention) Act 1967- Passed in 1967. - Aims to prevent unlawful activities that disrupt India's territorial integrity and sovereignty. - Central government has absolute power to declare activities unlawful via the Official Gazette. - Highest punishments: Death penalty and life imprisonment. - Applicable to both Indian and foreign nationals, including crimes committed abroad.
Investigative Provisions- Charge sheet filed within 180 days (extendable) after arrests.
2004 AmendmentAdded "terrorist act" to offences, leading to 34 organizations being banned. Previously, "unlawful" referred to secession and cession of territory.
2019 Amendment- Allows designation of individuals as terrorists. - Empowers NIA Director General to approve seizure/attachment of property. - Allows NIA officers (Inspector rank or above) to investigate terrorism cases.
